MOBILITY MADE EZ RENTAL AGREEMENT & TERMS OF SERVICE

By placing an order, completing checkout, accepting delivery, or using rental equipment from Mobility Made EZ LLC ("Mobility Made EZ"), Customer agrees to the following terms and conditions.

1. EQUIPMENT OWNERSHIP

All rental equipment remains the sole property of Mobility Made EZ LLC.

Equipment may include, but is not limited to:

  • Manual Wheelchairs

  • Mobility Scooters

  • Power Wheelchairs

  • Lift Chairs

  • Other Mobility Equipment

Customer receives temporary use of the equipment for the rental period selected during checkout.

2. RENTAL PERIOD

Rental charges begin at the time equipment is delivered by Mobility Made EZ and end at the scheduled return time.

A minimum two (2) day rental period applies to all equipment rentals. A two-day rental period consists of forty-eight (48) consecutive hours from the time of delivery.

For example, equipment delivered at 1:00 PM on Monday is due for return no later than 1:00 PM on Wednesday.

Additional rental charges may be assessed if equipment is not available for retrieval at the agreed-upon time.

3. RENTAL PERIODS & LATE RETURNS

Equipment not returned, made available for pickup, or left at the designated return location by the scheduled return time may incur additional rental charges.

Any portion of a day beyond the scheduled return time shall be considered an additional rental day and billed at the applicable daily rental rate.

Customer agrees that Mobility Made EZ may continue charging rental fees until the equipment is returned, recovered, and inspected.

Customer may also be responsible for additional recovery, service, transportation, or replacement costs associated with overdue equipment.

4. DELIVERY & PICKUP

Mobility Made EZ will deliver and retrieve equipment at the agreed-upon location.

Delivery fees, setup fees, and service fees are non-refundable once delivery has occurred.

Customer agrees to provide reasonable access for delivery and pickup.

5. HOTEL RENTALS

For hotel, resort, vacation rental, or similar lodging rentals:

Customer is responsible for the equipment throughout the rental period.

At checkout, equipment must be returned to the hotel front desk, concierge desk, bell desk, or other location designated by Mobility Made EZ.

Equipment is not considered returned until recovered and inspected by Mobility Made EZ.

Failure to leave equipment at the designated location may result in additional rental charges, recovery fees, or replacement costs.

6. EQUIPMENT CONDITION

Customer acknowledges that all equipment is inspected and in good working condition prior to delivery.

Customer agrees to notify Mobility Made EZ of any concerns regarding equipment condition within twenty-four (24) hours of delivery.

Failure to report damage within twenty-four (24) hours may result in the damage being presumed to have occurred during the rental period.

7. CUSTOMER RESPONSIBILITIES

Customer agrees to:

  • Operate equipment safely

  • Use equipment only for its intended purpose

  • Follow manufacturer operating instructions

  • Keep equipment secure and protected from theft or damage

  • Immediately report any damage, malfunction, accident, loss, or theft

Customer shall not:

  • Modify equipment

  • Attempt repairs

  • Transfer equipment to another individual

  • Use equipment in an unsafe manner

8. DAMAGE, LOSS & THEFT

Customer is responsible for all damage beyond normal wear and tear.

Customer authorizes Mobility Made EZ to charge the credit card on file for:

  • Repair costs

  • Parts replacement

  • Missing accessories

  • Missing chargers

  • Missing baskets

  • Missing keys

  • Excessive cleaning

  • Recovery expenses

  • Late return charges

If equipment is lost, stolen, destroyed, abandoned, or not returned, Customer agrees to pay the full replacement cost of the equipment.

Replacement cost shall be determined by Mobility Made EZ based upon the cost to replace the equipment with the same or substantially similar make and model at the time of loss.

Equipment left at an unauthorized location, public area, airport, transportation terminal, beach, amusement park, parking lot, or other unsecured location may be considered abandoned and subject to recovery charges, replacement charges, or both.

9. CREDIT CARD AUTHORIZATION

Customer authorizes Mobility Made EZ to maintain a valid credit card on file and place a temporary $500 authorization hold during the rental period.

Customer further authorizes Mobility Made EZ to charge the card on file for:

  • Rental fees

  • Delivery fees

  • Damage charges

  • Recovery costs

  • Cleaning charges

  • Late return fees

  • Full replacement costs for lost, stolen, abandoned, or non-returned equipment

10. SECURITY DEPOSIT AUTHORIZATION

Customer authorizes Mobility Made EZ LLC to place a temporary $500.00 authorization hold on the credit card provided at the time of rental.

This authorization hold is not a charge and is intended to help secure the rental equipment during the rental period.

The authorization hold may be used, in whole or in part, to cover:

  • Damage beyond normal wear and tear

  • Missing equipment or accessories

  • Missing chargers, baskets, keys, or components

  • Excessive cleaning fees

  • Recovery expenses

  • Late return charges

  • Loss, theft, or non-return of equipment

Provided the equipment is returned in satisfactory condition and all rental obligations have been fulfilled, Mobility Made EZ will release the authorization hold.

Customer acknowledges that the timing of the release is subject to the policies and processing times of the customer's financial institution and may take several business days to appear on their account.

11. ASSUMPTION OF RISK

Customer understands that mobility equipment involves inherent risks.

Customer voluntarily assumes all risks associated with operation and use of the equipment.

Customer agrees to operate equipment responsibly and within manufacturer guidelines.

12. RELEASE OF LIABILITY

To the fullest extent permitted by law, Customer releases and holds harmless Mobility Made EZ LLC, its owners, employees, contractors, and affiliates from claims arising from the use or misuse of rental equipment.

This includes claims involving:

  • Falls

  • Accidents

  • Injuries

  • Property damage

  • Equipment misuse

13. THIRD-PARTY PROPERTY DISCLAIMER

Hotels, resorts, vacation rentals, assisted living communities, cruise terminals, and other third-party properties are not parties to this agreement and assume no responsibility for the equipment.

Customer accepts sole responsibility for the rental equipment.

14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

Any dispute arising from or relating to this Agreement shall be brought in a court of competent jurisdiction located in San Diego County, California.

15. CANCELLATION POLICY

Orders canceled prior to delivery may be eligible for a refund.

Once equipment has been delivered, rental fees become non-refundable.

No refunds, credits, or prorated rental charges will be provided for equipment returned before the scheduled return date.

16. AGREEMENT ACCEPTANCE

By checking the box stating:

"I have read and agree to the Mobility Made EZ Rental Agreement and Terms of Service."

and completing checkout, Customer acknowledges that:

  • They have read this agreement.

  • They understand this agreement.

  • They agree to be legally bound by its terms.
